Terms and Conditions – Lux Mentium Education
Welcome to Lux Mentium Education! By accessing our website and using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully. If you do not agree to these terms, you must refrain from using our services.
1. General Information
Lux Mentium Education (“we”, “our”, “us”) provides online and in-person tutoring, educational resources, and other related services. By using our website, purchasing our products, or engaging with our services, you agree to these Terms and Conditions.
2. Services Offered
We provide tutoring services for students ranging from Kindergarten to Year 6, including:
Online tutoring sessions
In-person tutoring sessions
Educational videos and downloadable resources
Homework assistance
Other educational services as outlined on our website
All services are subject to availability and may change at our discretion.
3. Payment and Pricing
All payments for services, including tutoring sessions, video resources, and other products, are to be made through our designated payment methods, such as credit/debit cards or other secure payment gateways.
Pricing for services and products will be clearly stated on our website and may be subject to change. You will be notified of any changes prior to payment.
4. Booking, Cancellation & Refund Policy
Cancellations made with more than 24 hours’ notice will not incur a fee.
Cancellations made with less than 24 hours’ notice may be charged the full session fee at the discretion of the Company.
Cancellations made with less than 2 hours’ notice will automatically be charged in full, and the session will be forfeited.
Repeated last-minute cancellations may result in a suspension or termination of tutoring services.
5. Tutor & Staff Responsibilities
5.1 Professional Conduct
All tutors and staff are expected to maintain professionalism, confidentiality, and respect in all interactions with clients and students. Any inappropriate conduct, misconduct, or unprofessional behaviour may result in immediate removal from our platform.
5.2 Conflict of Interest and Tutoring Restrictions
To protect students and maintain ethical standards:
Staff must not privately tutor, solicit, or accept tutoring arrangements with students from the school, learning centre, or institution where they are currently employed in any capacity.
This restriction applies during their time with Lux Mentium Education and for 12 months after their engagement ends, unless written consent is provided by Lux Mentium Education.
Any breach of this clause may result in legal action, including but not limited to injunctive relief or financial compensation.
6. Parent and Student Responsibilities
6.1 Student Conduct
Students are expected to attend sessions on time, ready to learn, and to engage respectfully with their tutor. Repeated disruptive behaviour may lead to service cancellation.
6.2 Parental Conduct
Parents and guardians are expected to treat tutors and staff respectfully. Aggressive, inappropriate, or uncooperative behaviour may result in service suspension or termination.
7. Communication and Feedback
All communication relating to scheduling, feedback, or concerns must go through Lux Mentium Education via our official contact channels. Direct or unsolicited contact with tutors outside the platform is discouraged.
8. Intellectual Property
All educational materials, video content, lesson resources, and digital downloads provided by Lux Mentium Education remain the intellectual property of the Company. No content may be reused, shared, or republished without written permission.
9. Liability and Disclaimer
Lux Mentium Education provides a coordination service between clients and independent tutors. While we take care in selecting qualified staff:
We are not liable for any injury, loss, damage, or harm of any kind (including personal injury, emotional distress, or property damage) that occurs before, during, or after any tutoring session, whether conducted online or in person.
We are not responsible for the conduct, negligence, or actions of tutors, students, or guardians during any engagement.
We are not liable for any damage to property or belongings incurred during tutoring sessions.
By using our services, all parties accept and acknowledge that tutoring is undertaken at their own risk, and they release Lux Mentium Education from any claims of liability.
10. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in New South Wales.
